Fuel and fertiliser storage conviction upheld with probation in Midnapore

The Calcutta High Court on 24 February 2026 upheld a 1989 conviction of an oil and fertiliser dealer for storing diesel, kerosene and fertilisers without licences or papers. The court replaced the one-year jail term with probation and a Rs. 20,000 fine. The judgment records a victimless stocking and paperwork violation with no adulteration or diversion charge.

How we verify →

The conviction stands as modified: the dealer is on probation with a fine payable, and the trial court records were sent down.

What happened

The High Court recorded that enforcement staff inspected the dealer's oil store in Midnapore on 30.08.1984 and found stored fuels with no licence or papers produced on demand.

The judgment records the seizure as 200 litres of high-speed diesel in one barrel and two barrels holding 100 litres of kerosene each, plus fertiliser bags in an adjoining room with no licence, account books or returns.

The court noted that no stock-cum-rate board was displayed at the premises, which formed part of the control-order violations.

The court upheld the trial court's finding that the dealer failed to produce necessary documents for the seized goods, sustaining the conviction under Section 7(1)(a)(ii) of the Essential Commodities Act, 1955.

Given the lapse of about 42 years since the 1984 inspection, the court directed release on probation with a Rs.20,000 bond and a Rs.20,000 fine payable within 60 days, disposing of the appeal.
