Resort and hotel buildings in Udaipur eco-sensitive zone face seizure and demolition; writs dismissed
The Udaipur development authority ordered seizure and removal of hotel and resort constructions treated as unauthorised building in the Sajjangarh eco-sensitive zone. Owners holding conversion orders, allotments and pattas challenged the orders. The High Court decided the connected petitions together on 1 September 2026 and dismissed the writs.
This page records what the cited court, tribunal and government records say happened. Findings belong to the court or authority that made them; this register adds none of its own. Names of private individuals are withheld unless a naming gate clears them.
How we verify →The writ petitions stand dismissed and the authority's seizure and demolition action stands upheld.
What happened
The High Court recorded that the batch of petitions challenged orders directing seizure of hotel and resort premises on the ground that they were built in the eco-sensitive zone of the Sajjangarh Wildlife Sanctuary or other prohibited area.
The High Court recorded that one resort owner claimed ownership of Khasra Nos. 1797 and 1798 at Sisarma, conversion from agricultural to non-agricultural use in 2008, regularisation and allotment for resort use in 2009, and a registered lease deed or patta in 2010, before the 2017 eco-sensitive-zone notification.
The High Court recorded that the authority alleged construction without requisite permission and land-use change, while owners claimed deemed permission, prior approvals, and that the work was an extension of an existing resort rather than a new unit.
The Rajasthan High Court website summarises the outcome as: environmental protection prevails over private interest and investment or parity cannot legitimise unauthorised construction, and the writ petitions were dismissed.

A peaceful economic act
Building on claimed private patta land without or beyond plan sanction, or contrary to land-use and zone rules, has no complaining victim; the dispute is about how owners used their own premises.
What we could not confirm
The 44-page judgment was reviewed in excerpt; the final operative dismissal paragraphs at the tail were not captured verbatim from Indian Kanoon, so dismissal is supported by the Rajasthan High Court official recent-judgments summary. One UDA order labelled a four-storey construction as encroachment under Section 32, but the case is treated as own-land building control because the owners produced pattas, conversion orders and allotments rather than occupying public land.
