Police seized 2,527 kg of rice in 27 plastic and 24 jute bags in Nilambur in 2010 and prosecuted under the Rationing Order and Essential Commodities Act. The High Court found no witness proved the stock was public-distribution grain and the seizure witness disowned the inventory. It quashed all proceedings in C.C. No. 29/2018 on 15 February 2024.

What happened

The High Court recorded that on 25.08.2010 the accused was alleged to have hoarded 2,527 kg of rice in 27 plastic sacks and 24 jute sacks in premises hired by another accused.

The High Court recorded that the seizure attestor disowned the inventory signature and that there was no certification or other material showing that the seized stock was public-distribution rice or tracing its source.

The High Court recorded that the substratum of the prosecution case, even as against the petitioner, had been destroyed.

The High Court held that no purpose would be achieved by continuing the prosecution and quashed all proceedings against the petitioner in C.C. No. 29/2018.

What we could not confirm

No newer pure-hoarding case found; all 2025-2026 EC Act cases reviewed involved alleged PDS theft or diversion and were rejected.
