Drug maker forced to face Labour Court trial over senior executive's exit

The Assistant Labour Commissioner in Vadodara referred a dispute over a senior executive's resignation and separation to the Labour Court for adjudication. The company said the executive was a manager, not a workman, and had resigned voluntarily. The Gujarat High Court on 2 April 2026 dismissed the company's appeal and kept the reference alive.

How we verify →

The reference before the Labour Court, Vadodara survives and the employer must contest reinstatement and back-wages claims there.

What happened

The High Court recorded that the executive worked as Senior Executive/Manager Administration - Supervisor on Rs 76,268 per month, was relieved on 08.08.2023 with Rs 4,43,468 paid as full and final settlement, and then complained to the Assistant Labour Commissioner on 06.09.2023.

The High Court recorded that the Assistant Labour Commissioner by order dated 28.11.2023 referred the dispute to the Labour Court, Vadodara as Reference (T-LC) No.410 of 2023 on the question of reinstatement with continuity and back wages.

The High Court held that the appropriate government only forms an administrative opinion that a dispute exists or is apprehended, and whether the person is a workman or resigned voluntarily must be decided by the Labour Court on evidence.

The High Court concluded that the Single Judge committed no error in dismissing the company's writ petition, and dismissed the Letters Patent Appeal so the Labour Court adjudication will proceed.
