RPF seizure of gold bar at Bilaspur station left to Customs adjudication

Railway Protection Force officers seized a 1-kg gold bar at Bilaspur station and more gold from premises in 2021. The possessor challenged the 2022 Customs show-cause notice before the High Court. The High Court dismissed the writ as premature and left the case to Customs adjudication and appeal.

How we verify →

Writ dismissed on 16.09.2025; seizure stands and show-cause notice proceeds to adjudication with appeal remedy preserved.

What happened

The High Court recorded that a 1-kg gold bar was taken at Bilaspur railway station on 19.11.2021 and that further gold was taken from premises on 19-20.11.2021.

The Customs department said the seizure followed interception and papers pointing to foreign-origin smuggling and invoked the burden on the possessor to show lawful origin.

The possessor said the gold was of Indian origin bought lawfully with bills and that the search and show-cause notice dated 18.06.2022 were without jurisdiction.

The High Court held the writ against the show-cause notice was premature, involved disputed facts for the adjudicator, and that an appeal to Commissioner (Appeals) and CESTAT was available.

The High Court dismissed the petition and directed the petitioner to avail statutory remedies under the Customs Act, 1962.
