What this record means

This page records what the cited court records and reports say happened. Findings belong to the court or authority that made them; this register adds none of its own. Names of private individuals are withheld unless a naming gate clears them.

How we verify →

The proceedings in Case No. 1576 of 2020 stand quashed against both men.

What happened

The High Court recorded that the Incharge Inspector of Shahganj police station lodged an FIR on 02.04.2020 alleging the two had gone to the Nizamuddin Markaz in Delhi to attend a religious gathering and were staying at home secretly, with an apprehension they might be infected and infect others.

The FIR invoked Sections 188, 269 and 307 IPC (attempt to murder among them), the Disaster Management Act and the Epidemic Diseases Act; they were sent to a quarantine centre and police filed a chargesheet on 08.05.2020.

The High Court recorded that their Covid-19 tests were negative and that the State did not dispute the facts put forward by the applicants.

The High Court held they were falsely implicated and quashed the proceedings before the Additional Chief Judicial Magistrate, Jaunpur.

What the record says

“Thus, it is crystal clear that the applicants have been falsely implicated in the case with false and frivolous allegations due to ulterior motive and malafide intently and only on the basis of presumption and assumption.”

Punished for a freedom

Two men were prosecuted for six years, including for attempt to murder, because they had attended a religious gathering, though they tested negative and no one was harmed.

What we could not confirm

The case was brought under epidemic and public-health provisions, not a religion law; it is listed because the FIR rested on their attendance at a religious gathering.
